Condition of Contract Work with Green Services
There are 5 conditions that we need you to be made aware of in order to work professionally together:
- If there are any increases in the costs of materials or labor between creating this bid & purchasing them to start your services, if any additional work is added, and/or if any unforeseen circumstances arise during the completion of your services, we will revise this bid or create a change order accordingly.
- When we are hired to repair, retrofit, and/or install any irrigation and in doing so we realize there is something wrong with the existing pipe(s) or system once uncovered (i.e. it's old & brittle, in an inappropriate configuration, or we find a poly-vinyl tube and/or class 200 PVC under ground), we will also revise accordingly at stated above in #1.
- If we are bidding to install and/or repair your landscaping, it is the homeowner's responsibility for all maintenance of your landscape, everyday in the beginning, then weekly, monthly, or yearly as necessary (i.e. watching out for transplant shock, manufacture defects, insect infestations, animal issues, seasonal changes, & irrigation adjustments, leaks, or clogs, and also keeping up on the weeding, fertilizing, & pruning as necessary). We do not warranty any plant materials due to reasons that are beyond our control. Plants are a living thing & there are many aspects (i.e. water, nutrition, maintenance, weather, creatures, exposure, soil condition, etc.) that play a role in the plants health, quality, & longevity of life, that have nothing to do with our planting abilities or workmanship.
- If we are bidding to demo, remove, or prune then we are not responsible for the existing landscape (grass, irrigation, plants, etc.) around the area if it gets damaged while completing the services hired to perform (i.e. due to the required installation or removal procedures, and/or any machinery needed to complete the hired services).
- If there is for any reason a cancellation within 48 business hours prior to starting your services, you will be invoiced & responsible for a coordination fee (Min. $125 up to Max. 15% of the total amount of the services being canceled), for any consulting, troubleshooting, or evaluation services already completed ($125/hr.), and for any nonreturnable items already purchased and/or restocking or cancellation fees associated with materials ordered.

4. Limitations
In no event shall Green Services or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Green Services' Internet site, even if Green Services or a Green Services authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
